2. Scope
These General Terms and Conditions govern all purchases made through thelensking.com. By placing an order, you agree to these terms. We reserve the right to update these terms; changes apply only to orders placed after publication.
3. Products
All lenses sold are premium aftermarket replacement lenses. They are not manufactured by, endorsed by, or affiliated with the original frame brand. Brand names (Ray-Ban, Oakley, Maui Jim, etc.) are used solely for compatibility reference under nominative fair use.
4. Prices and Payment
All prices on thelensking.com are displayed in EUR and include VAT. The total price shown at checkout — including shipping and any applicable taxes — is the final amount you pay. Payment is processed securely via Stripe. We accept major credit and debit cards.
5. Order Confirmation
After placing an order, you will receive a confirmation email. The purchase contract is formed when you receive this confirmation. We reserve the right to cancel orders if products are out of stock or if pricing errors occurred, in which case you will receive a full refund.
6. Shipping and Delivery
We ship to all EU member states. Estimated delivery times are 3-7 business days depending on destination. Delivery times are estimates and not guaranteed deadlines. Risk of loss passes to you upon delivery. If a shipment is lost or significantly delayed, contact us and we will arrange a replacement or refund.
7. Right of Withdrawal (EU Consumer Rights)
Under Directive 2011/83/EU and the Italian Consumer Code (Codice del Consumo, Articles 52–59), you have the right to withdraw from your purchase within 14 days of receiving the goods, without providing any reason. To exercise this right, send a clear statement to support@thelensking.com before the withdrawal period expires; a model withdrawal form is available on request. You must return the goods within 14 days of communicating your withdrawal. The goods must be unused and in original condition. We will reimburse all payments, including standard delivery costs, within 14 days of receiving the returned goods. You bear the direct cost of returning the goods.
Exception for custom-made lenses: In accordance with Article 59(c) of the Italian Consumer Code (and Article 16(c) of Directive 2011/83/EU), the right of withdrawal does not apply to lenses cut to measure or otherwise clearly personalised to a frame you supply (our Custom Cut Service), as these cannot be resold. This exclusion is clearly indicated before you confirm such an order. Standard catalogue lenses are not affected and retain the full 14-day withdrawal right.
8. Satisfaction Guarantee
In addition to your statutory rights, we offer a voluntary 60-day satisfaction guarantee on our own terms. If you are not satisfied with standard catalogue lenses within 60 days of delivery, contact us for a refund or exchange. This commercial guarantee is in addition to, and does not replace or limit, your statutory right of withdrawal and legal guarantee of conformity.
9. Legal Guarantee and Commercial Warranty
Under EU consumer law (Directive (EU) 2019/771, implemented in Italy by the Codice del Consumo), you are entitled to a legal guarantee of conformity of at least 2 years. If a product does not conform to the contract, you have the right to repair, replacement, price reduction, or contract termination, as provided by applicable law. This statutory right is free of charge and cannot be limited.
In addition, and without limiting the above, we provide a voluntary 12-month commercial warranty against manufacturing defects (delamination, coating failure, incorrect sizing). The commercial warranty does not cover normal wear, scratches from use, chemical damage, or damage from improper installation.
10. Limitation of Liability
Our lenses are designed for everyday sunglass use and comply with the applicable EU standard EN ISO 12312-1 for sunglasses. They are not certified as personal protective equipment or safety eyewear unless explicitly stated. We are not liable for damage resulting from improper use, modification, or installation. Our total liability for any claim shall not exceed the purchase price of the relevant product. Nothing in these terms limits your statutory consumer rights.
11. Intellectual Property
All content on thelensking.com — text, images, logos, design — is the property of The Lens King SRL and may not be reproduced without written permission.
12. Privacy
Your personal data is processed in accordance with our Privacy Policy and applicable data protection laws including the GDPR.
13. Dispute Resolution
We encourage you to contact us first at support@thelensking.com to resolve any issues. If we cannot reach a resolution, EU consumers may turn to an alternative dispute resolution (ADR) body. A list of accredited consumer dispute resolution entities in the EU is available at https://consumer-redress.ec.europa.eu/dispute-resolution-bodies. Consumers resident in another EU country may also contact the European Consumer Centres Network (ECC-Net).
14. Governing Law and Jurisdiction
These terms are governed by Italian law. For consumers resident in the EU, the mandatory consumer protection provisions of your country of residence apply where they offer greater protection. For consumers, the competent court is that of the consumer’s place of residence or domicile (foro del consumatore). For all other parties, disputes are subject to the exclusive jurisdiction of the courts of Latina, Italy.
